Hue Lens provides a warranty that lenses supplied by it to customers shall be free from defects in materials and workmanship under normal use. Any product determined by Hue to be defective shall be repaired or replaced at Hue’s sole option. Such repair or replacement shall be Hue’s sole obligation and a customer’s sole and exclusive remedy hereunder and shall be conditioned upon return of such defective lenses back to Hue, within thirty (30) days after delivery of such lenses to customer. Except as expressly provided herein, Hue disclaims all other warranties, expressed or implied. This warranty shall be void and of no effect: (a) where lenses and/or coatings have been modified or repaired by any person or entity, other than authorized representatives; and/or (b) where the lenses and/or coatings has not been properly maintained or subjected to misuse, neglect or abnormal conditions.
